Abstract

NHS Wales Shared Services Partnership, on behalf of Hywel Dda University Health Board wish to inform the market that they intend to award a contract for the supply, installation, consumables and two years maintenance to perform full blood count analysis for the entire Carmarthenshire region. The hospitals included in this agreement would include Prince Philip General Hospital in Llanelli and Glangwili General Hospital in Carmarthen. CPV: 38434570, 38434570.

IV.1) Description

IV.1.1) Type of procedure

Award of a contract without prior publication of a call for competition

Justification for selected award procedure:

The procurement falls outside the scope of application of the Directive

Explanation:

The Pathology department is currently following a Procurement programme as part of Hywel Dda's modernising services strategy. There is a requirement to refresh the existing analysers as a two year interim measure. The current analysers will not be able to withstand two more years of service, it would not be practical or cost effective to alter the current supplier due to laboratory downtime, extensive staff training, loss of UKAS accreditation for the service and associated cost of change due to validation of new supplier equipment.

This is a temporary arrangement, an holding agreement while the NHS Shared Services Partnership Procurement Service completes a robust procurement exercise by 2019.

Hywel Dda Health Board can further rely upon regulation 32 (5)(b) which states

‘’for additional deliveries by the original supplier which are intended either as a partial replacement of supplies or installations or as the extension of existing supplies or installations where a change of supplier would oblige the contracting authority to acquire supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance; ‘’
