Response Requirements 8  Appendices Introduction Background Ysgol Gymraeg Bro Morgannwg (the School) wishes to purchase cleaning services for the School Buildings. The School is situated on one site with a main secondary school building, a primary school building and a Music and Drama building. We are a Welsh Medium 3-19 school providing education to pupils form across the Vale of Glamorgan. You'll find a school that is positive, warm and welcoming. A school that has the most fantastic range of facilities and staff with a 'can do' attitude. We work with every child as an individual ensuring that their educational needs are met so that they can flourish both within our school and when they leave. We currently have 1400 students on role and 120 staff. Objectives The School has identified a number of key objectives for the procurement of the cleaning contract. It must: deliver the highest possible standards. The School believes it is vital for the pupils development that they are taught in a clean and secure environment. deliver value for money. It is important that this project delivers efficiency savings. The successful bidder will understand the context in which the School operates and ensure a competitive cost underpinned by a commitment to the principles of cost avoidance, containment and reduction; support continuous improvement. The successful bidder must be committed to working with the School to identify and introduce improvements to the cleaning throughout the Contract period. Key Sites Ysgol Gymraeg Bro Morgannwg, Colcot Road, Barry CF62 8YU Primary School Building, Secondary School Buildings 12,943m2 (Main Building and Music and Drama Block) 1.4 Measurement of Building Whilst every effort has been made to be comprehensive and accurate it is recognised that some variations and omissions to the specifications may apply. Any rooms not otherwise specifically detailed should be cleaned as per the general office specification. The areas given should only be used as guide and any contractor submitting a tender for the supply of cleaning services is advised that the responsibility for the taking of measurements rests solely with them. However, as the building may not be accessible to take dimensions during the tender stage the contractor should make sufficient allowance for this. Scope and Operation Contract Scope and Duration The School intends to award a contract for the management and cleaning of the School site. (the Contract). The School reserves the right to amend the service specification if there is an operational need to do so. Due to the nature of the service sub-contracting is not acceptable on this contract. The anticipated Contract duration is four years with options to break after two and three years (2 years +1+1). 2.2 Current Services The current cleaning contract is managed by the Vale of Glamorgan Council via its direct labour organisation. The majority of the cleaning of the teaching areas, offices and common areas is currently undertaken outside the main part of the school day although we do have one cleaner on site during lunchtime and on certain occasions it may be necessary to have daytime cleaning and staff available for emergency cleaning. 2.3 Cleaning Equipment All of the existing cleaning equipment is the property of current Vale of Glamorgan Council and therefore the successful contractor will be expected to provide their own equipment, at their own cost for the duration of the contract. A list of the equipment you propose providing should be included in your tender submission. This should include innovative equipment that will improve productivity, reduce costs and achieve a high standard of cleaning service. Award Criteria and Timeline The Contract will be awarded to the most economically advantageous tender. Proposals will be evaluated on the basis of (55%) quality (45%) price. Quality Criteria will be evaluated as (Appendix A). Each section will be scored out of 100 and allocated a final weighting score. It should be noted that the School reserves the right to run a financial check on the winning bidder. However, the School reserves the right not to award all or any of the business to the best scoring bidder or to any bidder. Bidder Presentations As part of the tender evaluation, bidders will be required to give a presentation to the School concerning their proposal. The School will not be responsible for any costs incurred by a bidder in making such a presentation. General Service Requirements The contract will be required for 43 weeks of the year: 38 weeks term time 5 weeks periodic cleaning consisting of: 3 weeks Summer term 1 week Easter 1 week October or February half term All school buildings must be cleaned between 6am-8am and 3.15pm-6:15pm. Recess cleaning times can be facilitated with Site Team Manager. We require an onsite cleaner from 12pm to 2pm daily (term time) The total cleaned floor area of the School buildings is 12,943m2 The equipment and materials are to be supplied and maintained by the contractor. Conditions of Tender General All bidders will be subject to the conditions set out in this document and the document entitled Conditions of Tender for Suppliers attached at (Appendix B). Offers made subject to additional or alternative conditions may not be considered and may be rejected. The Form of Tender (Appendix C) must be signed by the individual(s) with the appropriate authority to make the commitment. Bidders may request clarification on the Invitation to Tender by using the Question and Answer facility on the Sell2Wales Website. Responses will be in writing and details of all such responses will be provided to all bidders. Bidders should be mindful of any commercial confidentiality they wish to be preserved in their request for clarification. Responses will only be made to questions received prior to 10th January 2022. Tenders must be open for acceptance for a period of ninety (90) days from the closing date for receipt of Tenders. Form of Contract The Tender shall be subject to the Schools terms and conditions of contract. Any conditions which the bidder may seek to impose shall be excluded and not form any part of the Contract unless each of these conditions have been specifically agreed to in writing by the School. Submission Tenders must be completed in English. Bidders must submit responses in accordance with the Response Requirements set out in Section 6 and use any templates within this document. When submitting tenders, please use the Sell2Wales postbox facility. Deadline for submitting tenders in accordance with the above procedures no later than 12 noon 31st January 2022. Response Requirements A response is required for each section as per Appendix A. Responses should be cross referenced to each section ie A1 etc. Please ensure all sections are all fully completed. The School reserves the right not to continue evaluating the tender if any of the responses are incomplete. Appendix A Quality Criteria The quality criteria are separated into six areas which are stated in table 1. Each of the areas will be evaluated using a series of pre-determined questions. The scores will relate to how complete an answer is given eg. Full marks for evidence that shows the company can meet our requirements fully Lower marks for partial evidence that the company can meet our requirements No marks where there is a failure to demonstrate ability to meet our requirements. If a tenderer fails to score in any of the quality categories this will result in automatic exclusion from the tender process. Each category has a weighting which contributes to the overall quality score. . Price45Total100 Section A Quality Management, Quality Systems and Monitoring The School believes that the control of Services can only be achieved by close control of the process that delivers the Service. The Contractor will be responsible for establishing and maintaining a policy for service quality and customer satisfaction. Commitment to, and development of, an effective operational quality system is therefore seen as essential. The following are the key quality areas required by the School. Each of these key quality areas will form a part of the Tender Evaluation Process. Tenderers are therefore requested to satisfy and complete each area to enable the School to evaluate quality submissions correctly. The Tenderer is to submit proposed methods of obtaining and documenting a quality management system to achieve: - Total MarksA1 Provide details of your internal and routine monitoring systems and any performance indicators to be employed (independently of any systems employed by the School) to ensure that the Required Standards are continuously achieved. 30  A2 Provide details of your pro-active management control procedure to show an achieved level of service. Particularly how resolutions of poor performance are achieved.30  A3Provide details of continuous training, particularly with new cleaning products and equipment.20A4 Provide evidence of the overall commitment to quality including the name and status of the person responsible for the quality management system. 20   Section B Management Structure and Management of Resources This Section will allow the School to evaluate the Tenderers proposed management structure and quality of resources to be applied to the organisation of the Contract. The School will assess whether Tenderers have applied sufficient resources, including staffing, skills, experience, management and support systems in their Tender to deliver the required Standard of Service. Each of the questions will be evaluated on the competence, thoroughness and relevance of responses and will look for evidence of experience of successfully working within the Secondary School/College environment. New Suppliers should answer B3 (a), the existing supplier should answer B3 (b). It is up to the Tenderer to submit evidence that will enable the School to assess the following:- Total Marks B1 Demonstrate your ability to provide a management and supervision structure with suitably qualified, locally based staff with sufficient experience to carry out all the duties associated with the service elements comprising the Contracts. New Suppliers shall provide evidence of previous TUPE transfers.30  B2 Provide details with previous examples of how you will organise the workforce to carry out the Service and provide flexibility to accommodate and/or respond to competing demands in different service elements whilst still managing the required standard of service. 30  (New Suppliers)B3(a)Tenderer shall supply a detailed plan for the management of the contract. The plan shall include but not limited to, a detailed start up and mobilisation programme that will ensure successful commencement, including a smooth transfer for staff under TUPE. Also detail the training plan that will be adopted for all employees prior to commencement, schedule of regular monitoring meetings and reports and a process for the resolution of issues.20  (Existing)B3(b)Tenderer shall supply a detailed plan for the management of the contract. The plan shall include but not limited to, details of staff training, schedule of regular monitoring meetings and reports and a process for the resolution of issues.20B4 Provide details of the allowance made and the means of determination to provide adequate cover for holidays, sickness and any other absences. 10  B5 Provide details of induction training and packages including length, duration and content to ensure that all operatives engaged on work associated with the Contract are aware of their legislative and contractual obligations. 10 Section C - Health and Safety Arrangements and Risk Assessments The aim of this assessment is to evaluate each company in its application and observance of the requirements of the Health and Safety at Work Act 1974. This is especially with regard to company health and safety arrangements for safe systems of work relative to each part of the operation. The Tenderer shall supply proposals for a safe system of working including a working proposal of how their procedures apply to the specification. It is up to the Tenderer to submit evidence that will enable the School to assess the following:- Total MarksC1 The Contractors proposed safe working arrangements for each element of the Service. 20  C2 Show how sufficient resources have been allocated to implement and monitor health and safety procedures together with the availability of safety equipment and facilities. i.e Personal Protective Equipment15  C3 Does the planned maintenance of machinery and equipment accord with the manufacturers instructions and relevant legal requirements ie PAT testing etc 15  C4 Submission of COSHH Assessments and Safety Data Sheets (if applicable)10  C5 Submission of Risk Assessments and action plans arising from the Risk Assessments 10  C6 The standard of training given to operatives relative to the tasks they are required to undertake. 10  C7 The name of the person who will ensure that the health and safety procedures are carried out and how the policy and procedures are conveyed to all employees. 10  C8 Procedures for the reporting of RIDDOR accidents, incidents and dangerous occurrences.10   Section D Method Statements Tenderers shall submit detailed Method Statements as required under the Specification. Each Method Statement will illustrate the way in which the Contractor proposes to clean individual units/areas across the School. Method Statements should be working documents that staff are able to read and follow to achieve the required quality standards. They should include the following areas and any other areas that the tenderer considers to be of significance: Total MarksD1 Method/Frequency of Cleaning25  D2 Storage, control and use of cleaning equipment and materials25  D3 Lone Working 25 D4  Security of Buildings 25 Section E - Equality and Diversity In accordance with employment law and good managerial practice the School takes steps to promote equality of opportunity in respect of its employment practices. It is the intention of the School to:- ensure that the workforce reflects the Community we serve; and Identify the special needs of the workforce. In order for the School to assess the extent to which a Contractor similarly complies with legislation and good practice already in place or underway it will be necessary for the Tenderer to provide certain information. The Tenderer must submit proposals of how the following will be demonstrated throughout the contract:- Total MarksE1 The monitoring of the workforce, including applicants, in order to ensure that the workforce profile in regard to ethnicity, gender, age and disability reflects that of the population served. 20  E2 That other policies are regularly reviewed to ensure compliance with the equalities policy, legislation, and best practise in particular those relating to Recruitment & Selection, Disciplinary, and Grievance 15  E3 Clear reference in employment documents to Disciplinary and Grievance procedures. 15  E4 Training provided for employees on equality issues 10  E5 The operation of Family Friendly/Work-life Balance practises e.g. in relation to maternity, paternity, and part-time employment issues. 10  E6 How will the tenderer show an awareness of service delivery needs within a diverse client group (e.g. disability access issues and access to services and information for ethnic minorities) and how these needs will be addressed. 10  E7 Proposals regarding Union consultation and recognition 10  E8 Demonstrate evidentially the organisations commitment to supporting the development of its employees in line with its business aims and objectives. 10Section F Environmental Considerations Tenderers are required to submit proposals to allow the School to evaluate the proposed commitment to, and the ability to comply with the requirements of the Environmental Protection Act and/or other relevant environmental legislative requirements and/or environmental regulations. It is up to the Tenderer to submit evidence that will enable the School to assess the following:- Total MarksF1 Tenderers proposals on efficient use of energy, electrical equipment and vehicles specific to this contract. 20  F2 Tenderers proposals for achieving sustainable working practices throughout the operations including the timescales. 20F3 Provide details of any environmentally friendly policies you may employ and how these can be interwoven into the Key Aim of the Contract Specification.15F4What measures you propose to minimise noise pollution in places of work.15F5Details of the chemicals and cleaning agents and control measures that you propose to use on this contract with specific reference to their effect on the environment. 15F6Tenderers proposals on reporting to the School and frequency of reporting statements15 Section G - Presentation This will comprise of a short 10 minute presentation followed by questions. More information will be provided after tenders are submitted. Each bidder agrees that its proposal is submitted on the terms and conditions set out in the tender document supplied, any associated documentation and this document. The bidder agrees that if successful, it will ensure that all employees, servants, agents, contractors or any persons wholly or partly under its control (Bidders Personnel) associated with this project adhere to the Schools Policies and Terms & Conditions. The appropriate insurance and DBS checks must also be in place. All Bidders Personnel will adhere to the Schools No Smoking Policy whilst on School premises. Copies of these documents are available upon request. Bidders, by submitting a tender, confirm that they understand and agree to the nature and extent of their obligations if their Tender is accepted. The Form of Tender supplied with the documents must be signed by the individual(s) with the appropriate authority to make the commitment. The bidder shall produce documentary evidence of such authorisation to the School if requested. The School does not bind itself to accept the lowest or any Tender and reserves the right to accept any Tender either in whole or in part. The School is a public Council for the purposes of the Freedom of Information Act and other related access legislation. Accordingly, third parties may request copies of documentation held by the School pursuant to rights granted to them under various access regimes. Section 43(1) of the Public Contracts Regulation 2006 provides Subject to the provisions of these regulations, a contracting Council should not disclose information forwarded to it by an economic operator which the economic operator has reasonably designated as confidential. Accordingly, if your organisation wishes to rely upon the above provision, please describe those parts of your tender you regard as confidential and set out your reasons why in your tender submission. Please note that it is the School that is responsible for determining whether a bidder has reasonably designated the information as confidential. Bidders are advised that even if they have designated the information as confidential, the School may not necessarily agree and the information may be released to a third party if the School deems it appropriate. Further, some information is required to be made public under other legislative requirements from time to time in force and organisations are asked to note this. Due to the nature of the service sub-contracting is not acceptable on this contract. Form of Contract Any successful bidder will be required to execute a contract with the School. The form of contract will be subject to approval by the Schools Governing Body. No binding contract will exist until the School and the chosen bidder execute and deliver a formal contract. Costs Bidders are responsible for obtaining all information necessary for the preparation of their respective tenders and all costs, expenses and liabilities incurred by any bidder in connection with the preparation and submission of a proposal or tender shall be borne by that bidder. A bidder shall be deemed to have full knowledge of the liability to be incurred by reason of the Tender and shall not, after acceptance by the School, be entitled to increase any prices or change any terms on the grounds that an error has been made or withdraw the Tender by reason of not having made enquiries which any prudent bidder would have made prior to responding to the Tender or for any other reason. Bidders shall take all reasonable care in the preparation and submission of a Tender and acknowledge that the School may rely upon the representations made in the Tender. All payments and royalties that may be payable shall be included in the prices detailed in the Tender and will be paid by the bidder to the relevant persons. The School shall not be responsible for or pay any costs, expenses or losses incurred by any bidder or would be bidder who fails to tender, in the preparation of their Tender. Submission Prices must be in sterling and must relate to all elements included in the proposal. All prices submitted by bidders must be inclusive of supply, including packaging and carriage but exclusive of VAT. Tenders containing clauses such as prices subject to fluctuation or those ruling at the date of delivery will not be accepted. All documents requiring a signature must be signed by an individual with the appropriate authority to make the commitment. Non-adherence to any of the above procedures may lead to disqualification. The School may, at its absolute discretion, extend the closing date above. Any such extension shall apply to all bidders. Notification of Selection All bidders responding to this document will be notified of the outcome of the Schools evaluation of their proposals. A bidder shall be deemed (for all purposes connected with the Invitation to Tender and any contract awarded as a result) to have carried out all research, investigation and enquiry which can reasonably be carried out and to have satisfied itself as to the nature, extent, volume and character of the Schools requirements (in the context of and as described in this Invitation to Tender. No bidder shall have any claim whatsoever against the School in respect of such matters and in particular (but without limitation) the School shall not make any payments to the bidder save as expressly provided for in any formal contract made pursuant to this Invitation to Tender. Confidentiality of Invitation to Tender This Invitation to Tender, the fact that a bidder has been invited to tender, and all other documentation issued by the School relating to the Tender (the Tender Documents) shall be treated by the bidder as private and confidential for use only in connection with the tender and any resulting contract and shall not be disclosed (save as may be required by law) in whole or in part to any third party without the prior written consent of the School. The Tender Documents and all copies of the same are and shall remain the property of the School (whether or not the School shall have charged a fee for the supply of such documents) and shall not be copied or reproduced in whole or in part and shall be returned to the School forthwith upon demand. If a prospective bidder decides not to respond to this Invitation to Tender, then the bidder is required to return the whole document unmarked to the School by the date and time set for receipt of tenders. Bidders may copy and disclose the Tender Documents to their professional advisers solely for the purpose of assisting in the preparation of a tender submission in response to this Invitation to Tender. Collusion and Canvassing Any proposal submitted by any bidder in respect of which the bidder: fixes or adjusts prices and rates shown in its proposal by or in accordance with any agreement or arrangement with any other person or by reference to any other proposal or communicates to any person other than the School the amount or approximate amount of the prices and rates shown in its proposal except where such disclosure is made in confidence, in order to obtain quotations necessary for the preparation of the proposal or for the purposes of financing or insurance; or enters into any agreement with any other person that such person shall refrain from submitting a proposal or shall limit or restrict the prices to be shown by any other bidder in its proposal; or offers or agrees to pay or give or does pay or give any sum of money, inducement or valuable consideration directly or indirectly to any person for doing or having done or causing or having cause to be done in relation to any other tender or any other persons proposal any act or omission; or in connection with the award of the contract commits an offence under the Prevention of Corruption Acts 1889 to 1916 or gives any fee or reward, the receipt of which is an offence under sub-Section (2) of Section 117 of the Local Government Act 1972; or indirectly canvasses any member, school governor or officer of the Council concerning the acceptance of any proposal or who has directly or indirectly obtained or attempted to obtain information from any such member or officer concerning any other bidder or proposal submitted by any other, shall be rejected by the Schoolprovided always that such rejection shall be without prejudice to any other civil remedies available to the School or any criminal liability of the bidder. Bidders Warranty In submitting a proposal a bidder warrants to the School that: it has not engaged in any of the acts or matters referred to in Clause 26 and has complied in all respects with these tendering requirements; all information, representations and other matters of fact communicated (whether in writing or otherwise) to the School by the bidder or its operatives in connection with or arising out of the Tender Documents (together with any proposal) are true, complete and accurate in all respects; it has made its own investigations and research, has satisfied itself in respect of all matters relating to the Tender Documents and that it has not submitted any proposal and will not have entered into any contract envisaged by the Tender Documents (the Contract) in reliance upon any information, representations or assumptions (whether made orally, in writing or otherwise) which may have been made by the School; it has full power to enter into the Contract and to make the provision required by the Invitation to Tender and will, if requested, produce evidence of such to the School; it is of sound financial standing and the bidder and its directors, partners, officers and employees are not aware of any circumstances (other than such circumstances as may be disclosed in the bidders proposal) which may adversely affect its financial standing in the future; it will procure and will have sufficient working capital, skilled staff, equipment, machinery and other resources available to carry out the Contract in accordance with its terms. Disclaimer Any and all documentation and other written or oral information provided or made available by Ysgol Gymraeg Bro Morgannwg has been prepared in good faith but does not purport to be comprehensive or to have been independently verified. To the full extent permitted by law the School does not accept liability or responsibility for the adequacy, accuracy or completeness of the Tender Documents or with respect to any other written or oral information provided or made available to the bidder. Legislation In submitting a response to this Tender, the bidder acknowledges full compliance with all UK and European Legislation relevant to the goods, services and works being proposed. Freedom of Information The School shall not be in breach of the provisions of Tender Documents or the Contract where it can show that any disclosure of Information* is made solely and to the extent necessary to comply with the Freedom of Information Act 2000 (the Act) or the Environmental Information Regulations 2004 (the Regulations) or any legislation of a like kind from time to time in force. To the extent permitted by the time for compliance under the Act or the Regulations, the School shall consult a bidder where the School is considering the disclosure of Information under the Act or the Regulations and, in any event, shall provide prior notification to the bidder of any decision. Whether or not to disclose Information in order to comply with the Act or the Regulations is a matter in which the School shall exercise its own absolute discretion, subject always to the provisions of the Act or the Regulations. Information means any information in any written or other tangible form disclosed to one party by or on behalf of the other party under or in connection with the Tender Documents or the Contract. I/We offer to provide goods / services set out in the Tender in accordance with the said Invitation to Tender for the amounts specified in the price schedule.
