Velindre NHS Trust acting as hosts of the NHS Wales Informatics Service intends to enter into a temporary extension of the current contract with Intersystems for the provision of a Laboratory Information Management System. The temporary extended contract will last for a period of up to 5 years (starting June 2020). The extension is necessary for NHS Wales to continue using the Laboratory Information Management System whilst the Trust undertakes a Competitive Dialogue tender for a new Laboratory Information Management System on behalf of NHS Wales and to allow sufficient time to migrate off the existing contract on to the replacement contract.

II.2.4) Description of the procurement

IV.1) Description
IV.1.1) Type of procedure
Negotiated procedure without prior publication
Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation:
The Trust makes this award under the negotiated procedure without prior publication in reliance on Regulation 32(2)(b)(ii) .Competition in this case is absent for technical reasons.The Trust is currently procuring a replacement all-Wales LIMS solution to modernise and improve the current service. The new procurement has started and is currently at the Invitation to Participate in Dialogue phase. It is necessary as a matter of urgency to extend the duration of the existing contract as the services are patient-critical and need to be provided in the meantime. Only the current contractor Intersystems can provide the interim service until procurement of the replacement laboratory information management solution can be taken and associated migration completed. Further rationale includes:
1. Any other supplier would need to provide a complete replacement service including implementation and testing which is unfeasible
2. Any other solution would need to interface with other NHS Wales systems and requiring a new solution to do so for a short duration is likely to be technically difficult and cause unacceptable levels of disruption to NHS services; and
3. Any other solution would create huge technical disruption and require huge use of NHS technical resources at a time when NHS Wales is undertaking the procurement of an all Wales laboratory solution.
4. Requiring another solution for the interim period would duplicate cost and resources in a way which NHS Wales cannot support or afford.
5. Furthermore, only InterSystems can continue to deliver the current services as it is the owner of the intellectual property of the system currently being used across NHS Wales.
