The council intends to vary the existing block bed contracts for these providers, which will increase capacity by a total of 39 beds.

The contract variations will commence in May 2018 and end on 31.7.2021.

IV.1) Description

IV.1.1) Type of procedure

Justification for selected award procedure:

The procurement falls outside the scope of application of the Directive

Explanation:

At present, Cambridgeshire County Council has a projected shortfall of 450 high quality affordable beds across the market. 150 of these beds are required to be affordable and sustainable directly commissioned by the council, and the remainder 300 to be available to the self-funder market. Therefore, the council launched the Care Homes development project to address the current and future requirements for care homes:

1— Workstream 1 to increase current block bed provision which could be available by May 2018,

2— Workstream 2 to incentivise the market to extend or build on their own land to increase capacity with a focus to increase capacity,

3— Workstream 3 to secure a strategic partner to build and run care homes on council owned land meeting the longer term needs of the market and Cambridgeshire residents.

This notice relates to workstream one, which aims to make best use of existing capacity and increase capacity in the short-term. The council will advertise the opportunity for providers to submit bids in relation to Workstream 2. There is currently a competitive dialogue competition underway in relation to Workstream 3.

Precise information on deadline(s) for review procedures:

The council is incorporating a minimum 10 calendar days standstill period from the date of publication of this notice. This period allows unsuccessful tenderers to seek further information from the contracting authority before the contract is entered into. Such additional information should be requested from (refer to address in part I.1). If an appeal regarding the award of contract has not been successfully resolved the public contracts Regulations 2015 (Chapter 6) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules, to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly. Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may order the ineffectiveness of a contract where serious breach have occurred in addition to any fine, the Court may instead provide for alternative penalties, either contract shortening, fines or both.
