While it is expected that novation will occur in April, there is the potential for unforeseen delays to result in the novation of the scheme to the MCS Charitable foundation taking place after the current contract completes on 30.4.2018.

II.2.4) Description of the procurement
This notice covers the contingency for a one month contract extension for the continuation of the current services provided by Gemserv as the administrator of the Microgeneration certification scheme (MCS), for the potential case of any unforeseen delays to the novation (making independent of government) of the scheme. The extension would cover the period from 1.5.2018 to 31.5.2018 but will only be awarded if the novation date is delayed until after 30.4.2018. 2 government incentive schemes (Feed-in tariff scheme, Renewable heat incentive) and the microgeneration industry rely on the functioning of MCS to develop and maintain standards, certify installers and installations in accordance with standards, to provide assurance to consumers and help the growth of the renewable microgeneration sector.

Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation:
The Department for business, energy and industrial strategy is in the process of novating (making independent of government) the MCS to the MCS Charitable foundation. Following novation, BEIS will no longer be responsible for contracting the delivery body for the scheme. However, there is a need for a contingency one month extension for the potential case of any unforeseen delays to novation. If novation occurs before the end of the current contract on 30.4.2018 as expected, the one month extension will not be needed. The modification does not alter the overall nature of the contract and the increase in price does not exceed 50 % of the value of the original contract and the following three month extension.
Given that the current contract ends on 30.4.2018, the department needs to have a contingency in place to ensure the continuous functioning of the scheme to support two government incentives (Renewable Heat Incentive, Feed in Tariff), consumers, and the industry while novation is finalised. A Voluntary ex ante transparency notice was published on 23.11.2017 — publication number 2017/S 225-469218 for a 3 month contract to expire on 30th April, this new VEAT is purely as a contingency of any slight delay, should it be required, to ensure business as usual.
We are claiming this extension against the Public Contracts Regulations 2015 — clause 72 (1) (c) (i),(ii) and (iii).
