Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation:
During 2012, the London Boroughs of Barking and Dagenham, Brent, Croydon, Havering, Lambeth and Lewisham (Partner Councils) jointly procured a contract to provide an ERP (Enterprise, Resource and Planning) solution based on Oracle Technology.
In 2012 a framework agreement was set up by the London Borough of Lambeth for 2 Lots. Lot 1 was for system implementation and Lot 2 for systems support and hosting. Lots 1 and 2 were awarded to Capgemini. The framework agreement allowed other named boroughs to call-off from the framework agreement. The London Borough of Croydon was a named borough and therefore called off from the framework agreement for Lot 1 and Lot 2. Each of the 6 partner Councils have separate contracts under the same framework. Under Lot 1 the 6 partner Councils implemented Oracle ERP and this went live on the 4.8.2014. The current call off contract for Lot 2 for system support and hosting is due to expire on 18.7.2018.
The reasons for extending the contract include the following:
1. The planned migration of the One Oracle system to the Oracle Cloud platform requires time to procure implementation services and then carry out the migration and configuration activities
2. The planned migration would not be fully completed before the end of the current hosting and support arrangement and extricating the 6 Partner Councils from the single solution requires a long lead time.
4. The position under the extension is similar in terms of price, the service is the same.
5. the OJEU threshold values for hosting services has not exceeded;
6. There is reference in the OJEU notice for the framework from which the contract was called off to it not being restricted to 4 years duration (therefore the market was on notice of a possible longer contract term.
7. The template call off contract forming part of the Framework contains referencing to the Council's ability to extend the term.
8. The increased value over the term of the extension does not shift economic power in the contractor's favour.
