This notice relates to the extension of the insurance-based TDP contracts for services provided in England and Wales.
II.2.4) Description of the procurement
The Housing Act 2004 requires a landlord to protect a tenant’s deposit from misappropriation in a government approved tenancy deposit (TDP) scheme for a home rented on an assured shorthold tenancy that started after 6 April 2007.
Insurance-based TDP schemes allow landlords or letting agents to hold the physical deposits and charge a fee that is used to buy insurance to protect the deposits. A tenant may make a claim to the scheme should his or her deposit not be returned at the end of the tenancy in accordance with statutory deadlines.
All TDP schemes are required to provide alternative dispute resolution as an alternative to the courts in the event of a dispute between tenant and landlord at the end of the tenancy.
This notice relates to one of three existing suppliers which each offer an insurance-based scheme. The schemes compete with one another for customers.

VII.2) Information about modifications
VII.2.1) Description of the modifications
Extension of contract period from 30 September 2020 to 31 March 2023.
VII.2.2) Reasons for modification
Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:
The modification meets the requirements of Regulation 43(1)(c) of the Concession Contracts Regulations 2016 including:
(i) the authority decided to abandon the re-procurement of the contracts due to the impact of the Covid-19 outbreak that a diligent authority could not have foreseen;
(ii) the modification does not change the overall nature of the concession contracts; and
(iii) the increase in value does not exceed 50 % of the value of the original concession contract.
Prior to the Covid-19 outbreak, MHCLG published a PIN on 2 September 2019 and received no market interest apart from the incumbent suppliers. MHCLG believes that a procurement during the Covid-19 outbreak is unlikely to generate more interest. Abandoning the procurement shall enable a more effective later procurement to be undertaken and allow mobilisation, implementation and transition to new contracts under normal conditions.
