This is modified in accordance with Regulation 43 (c) Concession Contract Regulations 2016. The modification will extend the Outdoor Advertising Contracts for a period of 3 years. The Council is relying on regulation 43 (c) as the need for the modification has been brought about by circumstances not foreseen by the council, the modification does not alter the overall nature of the contract and the increase price will not exceed 50 % of the original contract award value.

VI.3) Additional information

Section 43 of the Concession Contract Regulations 2016 (“CCR”) permits a variation to a concession contract for a range of circumstances. Under regulation 43 (c) this includes where:

- the need for the variation has been brought about by circumstances which a diligent contracting authority (i.e. the Council) could not foresee;

- the variation does not alter the overall nature of the concession contract; and.

- any increase in value is not higher than 50 % of the value of the concession contract.

It was not foreseen that following the EU procurement exercise undertaken in 2016, an award of a 15-year contract for the delivery of pavement advertising could not be made. The extension does not change the overall nature of the contracts, the value of the contract modification is less than the value of the original contracts and it does not change the economic balance in favour of the contractor.

The balance of interests in extending the contracts lies with the Council.
