IV.1) Description

IV.1.1) Type of procedure

Negotiated procedure without publication of a contract notice

Justification for selected award procedure:

The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons

Explanation:

The Air Commodities Team, part of the UK Ministry of Defence, intends to extend ACCOMM1a/7006 for a maximum period of 24 months commencing 1 Jan 18 with Percival Aviation Ltd for the modification of HHFE brackets which secure the Portable Hand Held Fire Extinguishers in place on the aircraft platform.

It is considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations (DSPCR) of 2011) for technical reasons.

The extension is required to modify the HHFE brackets which secure the fire extinguishers in place on the Aircraft. Percival Aviation is the Design Office for the HHFE brackets and has the experience and historical knowledge required to complete these activities are the required time frame.

Obtaining this equipment from another economic operator may have a detrimental effect on Platform airworthiness and a potential to increase platform safety risk.

This is primarily due to technical approval being required, in accordance with Military Aviation Authority (MAA) regulations and TAA approvals with an estimated time frame of 18 to 24 months prior to approval being granted for each aircraft platform, accompanied by a price commensurate with the time frame.

It would not be possible to ensure another economic operator could be sufficiently qualified, within the time frame to provide the modified HHFE brackets without incurring an unacceptable level of risk. This would result in the Authority not being able to fulfill safety requirements required to ensure the safe operation of the associated platforms within an Airworthy environment.
