Abstract

The Light Equipment Transporter (LET) Wheeled Tanker (WT) tractor 68T upgrade project aims to upgrade 78 WT tractors to enable the carriage of loads up to 44T, including all AJAX variants and application of armour kits. An upgraded 68T WT Tractor Concept Demonstrator has already been designed and built by Oshkosh Defense LLC, capable of a combined gross train weight of 68T; this equates to a payload of circa 44T. This contract aims to upgrade the remaining 77 WT Tractors.

Oshkosh shall be mandated to award the integration of the upgrade kits and armour kits in accordance with Regulations 40 - 45 of defence and security public contract regulations 2011. The integration shall be undertaken by a 3rd party, however, Oshkosh shall retain accountability for integration of the upgrade kits and armour kits as the prime contractor.

IV.1) Description

IV.1.1) Type of procedure

Negotiated procedure without publication of a contract notice

Justification for selected award procedure:

The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons

Explanation:

The vehicle support team – Operation support vehicle portfolio, part of the UK Ministry of Defence, intends to award an 18 month contract to Oshkosh Defense LLC (“Oshkosh”), for the upgrade of 77 light equipment Transporter Wheeled Tanker (WT) Tractors to enable carriage of loads up to 44 tonnes and application of armour kits. The estimated value of this contract is 22 500 000 GBP.

The contract shall be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1) (e) of Directive 2009/81/EC (Regulation 16(1) (a) (ii) of the UK defence and security public contracts regulations 2011) for technical reasons.

Oshkosh is the design authority and original equipment manufacturer for WT tractors. No other economic entity has access to the technical know-how to provide the authority with assurance that the integration of the upgrade kit does not compromise the operational effectiveness and safety of the platform. The WT tractor technical information is not available to the Authority and so cannot be provided to a third party.
