Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation:
Arun District Council owns a perpetual licence for the use of a Northgate Revenues and Benefits IT software application. The application and the database are Council assets that require support and maintenance. Northgate owns the Intellectual Property Rights (IPRs) for the software application and has not licensed them to third party maintainers. Therefore Northgate is the only provider for the application. The Council has previously attempted to undertake soft market testing to procure support services for the information@work system, that attempt at procurement demonstrated that there is effectively no competition as the support services can only be provided by Northgate as the owner of the information@work softwareo.
The information@work software is the proprietary software of Northgate and as such no other economic operator has access to the source code which is Northgate's intellectual property, access to the source code is necessary to provide the support services.
For the reasons set out above, Regulation 32(2)(b) applies to this procurement and consequently the Council believes that the negotiated procedure without prior publication may be used to procure these support services.
