The Contracting Authority has agreed to defer the carrying out of market testing and waive related market testing obligations in relation to soft facilities management services. In return, the Contracting Authority will receive the benefit of an internal benchmarking exercise and a reduced service payment.

IV.1) Description

IV.1.1) Type of procedure

Award of a contract without prior publication of a call for competition

Justification for selected award procedure:

The procurement falls outside the scope of application of the Directive

Explanation:

The changes to the existing contract are lawful because the modifications are not substantial within the meaning of Regulation 72(8) Public Contracts Regulations 2015. The modification to the contract does not materially change the services from those described in the original contract, nor does it change the economic balance in favour of the Contractor. The change will defer the carrying out of market testing and waive related market testing obligations in relation to soft facilities management services. In return, the contracting authority will receive the benefit of an internal benchmarking exercise and a reduced service payment. No additional conditions have been introduced that would have the allowed the admission of other candidates or attracted additional participants to the original tender procedure, or resulted in the acceptance of another tender.
