The works, supplies or services can be provided only by a particular economic operator for the following reason: protection of exclusive rights, including intellectual property rights
Explanation:
A call for innovation funding (Care leavers social impact bond) was made launched by DfE in January 2017. This was an openly advertised call for expressions of interest. In Sheffield one organisation responded to this request. No other representations were received during the period of the call for proposals, during which time any interested party may have submitted an expression of interest.
Thereafter, the organisation concerned developed solutions and established partners and investors which led them to establish exclusive rights, including intellectual property rights for the delivery of the programme.
The award of contract without prior publication in the Official Journal of the European Union is accordingly being made under Regulation 32 2.b.III of the Public Contracts Regulations 2015.
