IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation
The current provision ended on 31.3.2019. The Council previously called for competition however the process was unsuccessful. The Council is not yet ready to call for competition again and Regulation 72 of the PCRs does not provide for a modification which will allow the continuation of existing arrangements in the interim period. The Council has a statutory duty to provide residential and nursing care services to the Borough's vulnerable service users and therefore interim arrangements are required while a compliant procurement process is completed to establish a residential and nursing care services Framework Agreement. The interim transitional contract arrangement commenced on 1.4.2019 and will continue for up to 12 months. The transitional contracts will be awarded to economic operators who currently have a contract in place and the separate application process will continue to be open to currently non contracted economic operators should a service user request to be placed at that home. 16 additional operators have been awarded a contract via the application process. The details of all of the economic operators are available at request. This number will change over the course of the interim arrangements as providers contracts are terminated or added through the application process however the value will remain the same.
