Eastbourne Borough Council (‘EBC’) is looking to appoint a suitably qualified leisure management company to operate the Council's new flagship leisure centre incorporating swimming pools, fitness, commercial leisure and catering services. The facility is expected to open in November 2019 and there may be a requirement to operate the existing facility on an interim basis.

II.2.4) Description of the procurement
Further information about the process to be followed is contained in the Memorandum of Information available with the Selection Questionnaire (SQ) from the address in Section 1.3) of this notice: (https://www.sesharedservices.org.uk/esourcing). The first stage is the submission of the completed Selection Questionnaire in response to this notice requesting to be invited to participate. The deadline for the submissions of requests to be invited to participate is midnight 16.6.2017.
A Bidder Open Day will take place on Tuesday 6th June 10:30 at the Winter Garden, Compton Street, Eastbourne, BN21 4PB for potential bidders to be able to speak to the Council and acquire further information to further determine their interest in the project. The Council will provide an introductory presentation on the project and key project personnel from the Council will be present to answer questions and queries. Bidders that pass the SQ will be shortlisted for the submission of initial tender proposals. EBC may award the contract following initial tenders but reserves the right not to do so. EBC anticipates using a staged procedure to reduce the number of tenders to be negotiated. If EBC does not award after the initial tender then a number of bidders will be selected for further negotiation before final tenders are submitted after which it is intended that the preferred operator will be chosen.

Duration of the Concession: The core bid is expected to be a 10-year contract with an option for a 5-year extension. In addition, it is anticipated that the bidders will be asked to price for a 15 year contract with the option for a 5 year extension.
Estimated Contract Value: is based on a core 10 year contract term.

III.2.2) Contract performance conditions
The selected partner will be required to actively participate in the achievement of social and/ or environmental objectives. Accordingly contract performance conditions may relate in particular to social, environmental or other corporate social responsibility considerations. Further details of these conditions will be set out in the procurement documents.
EBC reserve the right to require groupings of contractors to take a particular legal form or to require a single contractor to take primary liability or to require that each party undertakes joint and several liability.

All discussions and meetings will be conducted in English, pricing must be in GBP and the process and the contract will be governed and construed in accordance with English law.
Participation and the costs and expenses of doing so are entirely at the risk of economic operators and will not be refunded by the contracting authority under any circumstances. The contracting authority shall not be responsible for any costs, charges or expenses incurred by participants and accepts no liability for any costs, charges or expenses, irrespective of the outcome of the competition, or if the competition is cancelled or postponed.
All dates and time periods specified in this notice are only provisional and the contracting authority reserves the right to change these.
The contracting authority reserves the right to not run any form of competition or award any or part of this contract.
Candidates are advised that the contracting authority is subject to the Freedom of Information Act 2000 (‘the Act’).
