Abstract

The Secretary of State for Defence (the “Authority”) intends to enter into a contract with Ontic Engineering and Manufacturing UK Limited (“Ontic UK”) for the procurement of spares, post design services and repairs to support a variety of avionic equipment used on Hawk, Chinook, Gazelle, Tucano, Wildcat and vintage aircraft operated by the Battle of Britain Memorial Flight. The contract has an estimated value of 6 800 000 GBP and a duration of 2 years (+ option to extend for 1 year).

The avionic equipment in question is limited to:

— GE Aviation manufactured avionic equipment for which Ontic UK has proprietary legacy capability,

— Avionic equipment originally manufactured by Penny and Giles Controls Ltd, Racal Acoustics Ltd, Ultra Electronics, Honeywell International Inc., Thales UK and Eaton Aerospace Ltd. In each case, according to the Authority’s understanding, Ontic UK is the sole licensee for manufacture and support of the relevant equipment.

The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons

Explanation:

The Secretary of State for Defence (the “Authority”) intends to enter into a contract with Ontic Engineering and Manufacturing UK Limited (“Ontic UK”) for the procurement of spares, post design services and repairs to support a variety of avionic equipment used on Hawk, Chinook, Gazelle, Tucano, Wildcat and vintage aircraft operated by the Battle of Britain Memorial Flight. The contract has an estimated value of 6 800 000 GBP and a duration of 2 years (+ option to extend for 1 year).

The avionic equipment in question is limited to:

— GE Aviation manufactured avionic equipment for which Ontic UK has proprietary legacy capability,

— Avionic equipment originally manufactured by Penny and Giles Controls Ltd, Racal Acoustics Ltd, Ultra Electronics, Honeywell International Inc., Thales UK and Eaton Aerospace Ltd. In each case, according to the Authority’s understanding, Ontic UK is the sole licensee for manufacture and support of the relevant equipment.

It is considered that this Contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011) for technical reasons. Ontic UK are the only economic operator with the necessary technical data, proprietary information, test equipment, knowledge and experience required to carry out the contract to maintain operational capability and ensure the safe functioning of the Armed Forces. Ontic UK hold the licenses, manufacturing information and technical expertise necessary to provide the required services.
