BEIS intends to award a contract to CTSI to continue delivery of ODR from July 2019 to December 2020. The ODR contact point is a phone and online information and support service to assist parties in disputes about online purchases submitted via a Europe-wide ODR platform. The contract covers the cost of running the service only.
ODR facilitates communication between parties in a dispute and a relevant ADR entity. This includes, but is not limited to: assisting consumers submitting a complaint via the platform with completion of relevant documentation; providing the parties and relevant ADR entities with consumer rights information relating to sales and service contracts applying in the Member State hosting the ODR adviser; providing information on the functioning of the platform; providing explanations of the operational rules and processes applied by the relevant ADR entities; and informing the consumer of other means of redress available if a dispute is not resolved through ODR.

Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation:
The ODR contact point needs to be retained until at least October 2019. Under the withdrawal agreement negotiated between the UK and EU, it is further expected the ODR contact point will continue until at least December 2020. The future of the ODR contact point thereafter is contingent on the future economic partnership with the EU and associated policy decisions. A new contract is required to run for 18 months from July 2019 to December 2020.
The appointment is made under Regulation 32 (2) (b) (ii) of the UK’s Public Contract Regulations 2015. The ODR contact point is currently delivered by CTSI. CTSI has the necessary personnel, equipment and experience in place. The same team also currently partly deliver the European Consumer Centre, a larger consumer advice service; this will be delivered by CTSI until end of December 2020. It is impractical to deliver the ODR contact point in isolation from the ECC, and is also reliant on the skills held by CTSI personnel.
Given the uncertain future of the ODR contact point and the resultant short contract period; strong interdependency with the ECC; the low value of the contract; the low number of people needed to deliver the service; and advisor training time required, continuation of delivery by the incumbent is the only realistic option for this period.
