Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation:
The vehicle support team – Armoured Tracks Portfolio (VST-ATP), part of the UK Ministry of Defence (MOD), intends to let a new contract with Thales for storage and logistics transfer of Battle Group Thermal Imager (BGTI) equipment.
This contract will be let using the negotiated procedure without prior publication of a contract notice in accordance with Article 28(3)(a) of Directive 2009/81/EC (Regulation 16 (1)(d)(i) of the Defence and Security Public Contract Regulations 2011).
This contract is necessary for the storage, transfer and logistical dependencies during an interim period until the appointed logistics and storage provider is able to facilitate the transfer and ongoing storage. Thales currently provide the storage for the BGTI equipment and, in accordance with Reg 16(1)(d)(i)(aa), the MOD cannot, for economic reasons, have this contract carried out or provided separately without incurring major inconvenience.
