II.2.4) Description of the procurement
Spares for heavy machine guns, general purpose machine guns and mortar 81 mm. Babcock Land Defence Ltd, which is acting as the agent for the for the UK Ministry of Defence known as the authority, is considering a framework agreement to provide for the supply of general purpose machine gun and 81 mm mortar spares. The duration shall be 5 years with 2 x 1-year options.
All items within scope are codified to NATO Stock Numbers (NSNs). Down selected tenderers shall be invited to submit bids for CSIS compliant parts. The complaint Manufacturers Part Numbers (MPNs) are detailed on the Codification Support Information System (CSIS) maintained by the United Kingdom National Codification Bureau, further details can be found on the CSIS/UKNCB website.

Justification for selected award procedure:
No tenders or no suitable tenders/requests to participate in response to restricted procedure
Explanation:
Babcock Land Defence Ltd, acting as agent for the UK Ministry of Defence, intends to negotiate a single source contract with FN Herstal UK for the supply of HMG, GPMG, 81 mm mortar spares and accessories.
The single source contract is intended to be for a period of 5 years and will include 2 x 1-year extension options; making a maximum potential contract duration of 7 years.
It is considered that this contract can be placed using the negotiated procedure without prior publication pursuant to Regulation 16(1)(a)(i) of the Defence and Security Public Contract Regulations 2011 (the ‘DSPCR’) (Article 28(1)(a) of the Directive 2009/81/EC) due to the absence of suitable tenders received in response to a call for competition (reference 2019/S 146-360833) under the ‘restricted’ procedure set out in Regulation 17 of the DSPCR.
This notice is not for expressions of interest, therefore please do not apply to be invited to tender. The notice advises that the UK Ministry of Defence has decided to negotiate a contract directly with FN Herstal UK on a single source basis and is published for reasons of transparency only.
