Abstract

Torbay Council has reviewed how some of our services for children, young people and families are delivered. We want to help build the capability and capacity of children, young people, parents and the community to support themselves and others. For outcomes to change and improve a transformational way of working needs to be implemented. Current services for the 0 to 19 population are delivered as separate services causing duplication, missed opportunities, unnecessary handovers and confusion in the population on where to go to for children’s early years support. To achieve improved outcomes the culture of commissioning and service delivery needs to radically shift to one of integrated outcomes focused delivery and this contract indicates a start of that journey. We want a future system that is based on the strengths within individuals, families and communities and works to build upon these rather than focussing solely on deficits. The current contracts expire on 31.3.2019 and the new service has to commence on 1.4.2019. In addition there is a need to deliver savings from 1.4.2019 onwards against the current cost of providing these services, so any delay in commencing the new service will result in reduction in the level of savings that can be delivered.

The tender process did not result in the award of a contract. In order to achieve the contract start date of 1.4.2019 Torbay Council is intending to enter into negotiations with the 3 organisations who are currently providing the services which may result in the award of a contract.

IV.1) Description

IV.1.1) Type of procedure

Justification for selected award procedure:

No tenders or no suitable tenders/requests to participate in response to open procedure

Explanation:

Torbay Council ran an open tender process to appoint a supplier do deliver the Service, see OJEU Contract Notice 2018/S 094-213500 and Contract Award Notice 2018/S 187-423121. Of the 2 bids received one was non-compliant as it did not meet the stated requirements in relation to budget and the other was evaluated, but was not capable of meeting the minimum requirements set out in the tender documents, without substantial changes. The Council was therefore unable to award a contract. The new service needs to be in place for 1.4.2019, in order to meet timescales for the end of current arrangements and also to deliver the level of financial saving required for both the 2019 financial year and duration of the contract. There are currently 3 separate organisations delivering the services that will be integrated under this contract, the Council is intending to enter into negotiations with these suppliers with a view to awarding a contract should the negotiations be successful. If negotiations prove unsuccessful the Council will be required to undertake a procurement process, which will result in a delay to the start of the contract and impact on the value of the contract and savings achievable. The Council does not intend to alter the scope of the service or its minimum requirements. The contract duration will remain as set out in the original tender on the basis that it will take time to transition to the model of delivery and time will be needed to embed the model before the contract can be retendered. To better facilitate the implementation of the new model the Council is likely to consider an increase to the budget. It is not expected that any increase will exceed 10 % of the original budget and any increase may be smoothed over the initial contract term. The original budget included a capital allowance of 300 000 GBP which may be removed in the event that a lower than anticipated level of saving is proposed for Year 1. Article 32 of Directive 2014/24/EU allows for a contracting authority to award a contract following a negotiated procedure without prior publication where no suitable tenders are received.
