Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation:
The C17 Command Support and Airborne Equipment Project Team (C17CSAE PT) as part of the UK Ministry of Defence (MOD) has a requirement for the provision of Energy Dissipating Material (EDM) for airdrop parachute systems.
It is intended to award a new Contract up to the value of 2 000 000 GBP with Dufaylite Limited. It is intended that this contract is let until 31.3.2020. It has been determined that this Contract can be placed using the Negotiated Procedure Without Prior Publication of a Contract Notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011) for technical reasons. This is because the In-Service Container Delivery System (CDS) utilises and is designed around the specification of the current EDM, which has been extensively trialled for Airborne Equipment Release Certificate (AERC) clearance and is the only EDM product that has an airworthiness clearance for in-service use on the CDS system.
The specific equipment items to be procured by this contract are manufactured by Dufaylite as the Original Equipment Manufacturer (OEM). Only Dufaylite has the required technical knowledge of the manufacturing process to manufacture the specific product with the required technical performance assurance for airworthiness to ensure the safe operation of UK MOD airdrop systems.
