IV.1) Description

IV.1.1) Type of procedure

Negotiated procedure without publication of a contract notice

Justification for selected award procedure:

The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons

Explanation:

“The Defence Electronics and Components Agency (DECA), part of the UK Ministry of Defence, intends to award a contract to Raytheon Systems Ltd (“Raytheon”) for Post Design Services (PDS), repair and disposal of navigational aids fitted to Hawk and Tornado aircraft, for a period of 4 years (with an option to extend this for a further year.)

It is considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations of 2011). This is for technical reasons.

The equipment covered came into service between the early 1970s and 1989 has been supported and maintained by Raytheon throughout its life. Only Raytheon has the knowledge, tooling and test equipment in place to continue supporting this equipment.

Pursuant to the Military Aviation Authority’s Regulatory Article 1005(2) “Design Organisations” only a competent design organisation shall be contracted for PDS of Air Systems. Raytheon Systems Limited are the only Design Approved Organization Scheme (DAOS) accredited design organisation for this equipment.

Due to the age of the equipment involved there are multiple obsolescence issues and additional obsolescence issues are highly likely over the remaining life of the equipment. The obsolescence issue must be rectified to ensure continued support to the Hawk and Tornado platforms. Failure to do so would result in Aircraft being grounded. As a result, there is a specific safety requirement which must be fulfilled to ensure the safe functioning of the Armed Forces. Raytheon are the only economic operator that can maintain and provide PDS for the equipment as they are the only economic operator with the know-how, tools and means to meet the requirement.”
