Precise information on deadline(s) for review procedures:

The Vale of Glamorgan Council will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the Council before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. Such additional information should be requested from the Council.

If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts Regulations 20014 (SI 2006 No 102) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages.

High Road route
The route is not high load route at present. However, the structure drawing in the package gives a clearance of 6.45m which is that required for a high load route.

The structure is to be constructed to give high load route clearance as shown on Drg. No. 3512646D-HHC – Figure 3.3.

Further to previous question about BAR and Activity Schedule
We have given further consideration and advise.

Tenderers should Refer to Section C of Volume 0. The purpose of the BAR is to clarify to the Employer how the Total of The Prices has been established. The activity schedule should be broken down into sufficient detail to reflect the narrative contained within the BAR. The tenderer will complete the ‘tenderer’s assumptions’ sections of the BAR ( expanded as appropriate) and return it within the Technical envelope (un-priced) and Commercial envelope (priced, as B3.1 above). The prices that may be inserted by the tenderer within the BAR will correspond with the Prices within the Activity Schedule. The total price in the BAR and priced Activity Schedule should have the same financial value.
