Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation:
The awarding of the contract has been made without prior publication in the Official Journal of the European Union due to a number of critical factors. It has been imperative to secure the continuation of provision from provider for the delivery of medical ultrasound education; to secure an agreement with provider will provide continuity to NHS Wales which is critical in this educational need.
This agreement is planned to be an interim solution especially due to the complication of the Covid-19 pandemic.
A previous tender demonstrated there are a very limited number of prospective providers who could potentially fulfil this educational need. Furthermore, there are even less providers who meet the specification within close proximity to Wales; providers also require an established Programme will be CASE accredited. Due to the exceptional requirements, only one provider has demonstrated the ability to meet all needs.
Due to the Covid-19 pandemic, provider also has further developed ways to deliver academic elements within the Programme which is critical as a customer and also, other providers would not be in a position to achieve this.
This agreement will take the ultrasound education through to 22/23; for any future requirements, a long term procurement exercise will be conducted where a high quality Health Professional Education and Training Service will be fulfilled. To achieve this, significant engagement will be undertaken to ensure acceptable procurement avenue is pursued.
