II.2.4) Description of the procurement

Cardiff and Vale University Health Board require emergency support services for a complex and highly specialised nursing support. This contract is an emergency measure to ensure Cardiff and Vale UHB have sufficient provision for abnormally complex care needs of an individual patient. The Department has no capacity to provide specialised care for this inpatient at this current time. A registered nurse with specialist training in mental health was required to provide care on a one-to-one 24/7 assignment basis, as well additional Health Care support workers were required on a three-to-one 24/7 assignment basis.

IV.1.1) Type of procedure

Award of a contract without prior publication of a call for competition

Justification for selected award procedure:

The procurement falls outside the scope of application of the Directive

Explanation:

A patient was urgently admitted in October 2023 without warning into Cardiff and Vale Health Board’s in-patient clinic. The Health Board had no knowledge of the patients’ condition, health requirements and required care plans upon admission. The patient suffers from a series of health problems which have detrimental effects on their mental and physical health. The Health Board recognised that the patient required continuous highly specialised mental health care and further supporting care until a suitable placement is established. At this point, with patient and staff safety in mind, the only option was to implement a reliable continuing health care package with Prometheus Complex Care. A registered mental health nurse, and three health care support workers were immediately required to care for the patient on a 24-hour basis. The company offered the required clinical support and has sufficient expertise in providing care for patients suffering with various types of eating disorders. The Health Board must ensure that the patient receives a continuity of care which is currently being delivered by the assigned RMN’s and support workers. Carers assigned to the patient have already built a good relationship with the patient and small improvements are being made with regards to their health. A sudden change in care provider could cause significant distress to the patients’ mental and physical health. Therefore, in line with regulation 32(2)(b), competition is absent for technical reasons and no reasonable alternative or substitute exists due to the need to ensure continuity and reliable care for the patient's wellbeing. This arrangement is only for a short-term period, as the vulnerable patient is currently under constant review. The Health Board will be placing the patient in a permanent NHS provided setting in the long term.
