II.2.4) Description of the procurement
Cardiff and Vale University Health Board require emergency support services for a complex and highly specialised Continuing Health Care Package. This contract is an emergency measure to ensure the Cardiff and Vale UHB Mental Health department have sufficient provision for abnormally complex care needs. The Department has no capacity to provide specialised care for this inpatient at this current time. Therefore, a registered nurse with specialist training in mental health or registered learning disability nurse is required to provide care on a one-to-one 24/7 assignment basis as well as additional Health Care support workers are required on a five-to-one 24/7 assignment basis.

Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation:
On admission, the patient showed significant risks of dysregulation with aggression and violent behaviours. As well as other challenging behaviours that pose a risk of harm to the patient and carers. Therefore, highly specialised Health Care professionals were required immediately. The requirement for a 24/7 care package has been offered to contracted agencies and no agencies were able to provide staff with the volume or continuity and reliability required. There is not a contracted agency able to provide a package only ad hoc service. In line with regulation 32(2)(b), competition is absent for technical reasons and no reasonable alternative or substitute exists due to the need to ensure continuity and reliable care for the patient's wellbeing. With patient risk in mind, the only option is to implement a reliable continuing health care package with Thornbury Nursing Services.
