When this contract comes to an end, it is anticipated that there will be a requirement to re-tender subject to continuation of Welsh Government funding.
The Services to which this Notice relates fall within Regulations 74 to 76 of the Public Contracts Regulations 2015 (Regulations). Although the contracting authority may voluntarily adopt certain provisions in the Regulations neither the employment of any particular terminology nor any other indication shall be taken to mean that the contracting authority intends to hold itself bound by any of the Regulations save those applicable to services falling within Regulations 74 to 76. Bidders should note that they will be required to enter into terms and conditions of contract as set out in the tender documents and that save for matters of clarification or consistency the contracting authority will not negotiate the terms.
As this is a procurement that falls under the LTR the contracting authority is proposing to use a procurement procedure, which is akin to the open procedure. Velindre University NHS Trust will award the contracting entity as hosts of NHS Wales Shared Services-Procurement Services. For the avoidance of doubt, HEIW will be entering into the contracts with the appointed providers.
All tender costs and liabilities incurred by bidders shall be the sole responsibility of the bidders. The contracting authority reserves the right to award the Contracts in whole or in part. The contracting authority reserves the right to pause, halt and/or annul the tendering process and not to award any of the Contracts. The Contracts to which this procurement relates, are funded via Welsh Government funding. Please refer to the draft contract terms and conditions for rights reserved to the contracting authority should the said funding cease or reduce.
The proposed contracts are due to take effect on or around 1/08/2021 and provide for a 12-month implementation period. Delivery of the services under the proposed contracts are to commence upon the anticipated Services Commencement Date (that is, on or around 1/08/2022). No contract payments are payable in respect of the 12 month implementation period. Whilst bidders are free to submit bids in respect of any number of Lots and/or Sub-lots, in relation to Lot 1 successful bidders will be limited to the award of no more than 3 Sub-Lots. Please refer to the ITT for further details. Bidders to note that each Sub-lot and/or Lot (where relevant) will be evaluated separately using the pre-disclosed evaluation criteria set out in the ITT.
