IV.1.1) Type of procedure

Justification for selected award procedure:

The procurement falls outside the scope of application of the Directive

Explanation

The Contracting Authority has awarded this contract directly to Oracle Corporation UK Limited in accordance with the applicable procurement regulations on the grounds of technical compatibility, absence of reasonable alternatives, and protection of critical service continuity.

The justification is as follows:

Technical Compatibility: The existing Patient Management System (PMS) is built upon Oracle database technology. Alternative database solutions available under the relevant framework are not technically compatible with the current PMS architecture. Implementing an alternative solution would require significant system redesign, data migration, testing, and revalidation activities, creating disproportionate cost and operational risk.

Absence of Reasonable Substitutes: No alternative supplier is able to provide equivalent licensing and support services for the existing Oracle-based infrastructure without introducing material technical and commercial disadvantage. Oracle resellers do not offer additional contractual, financial, or service benefits beyond those available directly from the Original Equipment Manufacturer (OEM).

Operational Continuity and Risk Management: Oracle technology is embedded across multiple systems within the organisation. Transitioning to a different database platform would introduce interoperability challenges, require additional workforce training, and create avoidable disruption to essential clinical and operational services.

On this basis, the Contracting Authority considers that the direct award is objectively justified and proportionate to ensure system stability, patient safety, and continuity of service.
