Justification for selected award procedure:
Extreme urgency brought about by events unforeseeable for the contracting authority and in accordance with the strict conditions stated in the Directive
Explanation
This Direct Award Agreement has been made to 4 suppliers who won places following an OJEU compliant procedure on a previous rock salt framework, which expired in March 2020. Resources allocated to the renewal procurement have been diverted to support urgent activity regarding Covid 19. It is necessary for agencies to commence restocking over the summer months for logistical reasons. The inability to do this would lead to insufficient stocks in winter with the potential to cause major disruption on the roads and potentially loss life. This interim 12 month agreement is required to secure continuity of supply and to ensure the safety of the Welsh Public whilst a new full procurement process is conducted. The award has been made under the exception permitted in Regulation 32 (2)(c) of the Public Contracts Regs 2015
