Justification for selected award procedure:

Extreme urgency brought about by events unforeseeable for the contracting authority and in accordance with the strict conditions stated in the Directive

Explanation

Due to time constraints from the urgent requirement of this facility it is not possible to undertake a tendering exercise. Therefore This procurement was carried out as a direct award contract in accordance with Regulation 32 (2) (c) insofar as is strictly necessary where, for reasons of extreme urgency brought about by events unforeseeable by the contracting authority, the time limits for the open or restricted procedures or competitive procedures with negotiation cannot be complied with. This is because of an extremely urgent requirement to build a hospital in relation to the unforeseeable event of the COVID-19 pandemic

Due to time constraints from the urgent requirement of this facility it was not possible to undertake a tendering exercise and so two contractors from the South West Wales Regional Contractor’s Framework 2020 (SWWRCF 2020) were approached to confirm capacity to carry out the works. Swansea Council are the Principal Contractor and both Kier Construction Limited and T Richard Jones (Betws) Ltd are both sub-contractors.

Due to the emergency nature of these works it is not possible to establish a contract sum. The estimated outturn costs will be 10,000,000 GBP - 15,000,000 GBP (combined for both contracts).

The full costs associated by this contract will be reimbursed by The Swansea Bay University Health Board.
