Explanation:
The Warship Support Project Team, part of the UK Ministry of Defence, intends to place a short-term contract with Drumgrange Limited for the provision of support to the Minewarefare Tactical Support System (MTSS) including Post-Design Services and repair/maintenance support to allow for 12 months continued support with an option to extend for a further 6 months The value of this contract is estimated to be 550 000 GBP (ex VAT). The original design and development contract was placed in 2004 following competition and support contracts have been placed with Drumgrange as Design Authority in previous years. The current 6 month support contract expires on 31.3.2016.
It is considered that this contract can be placed with Drumgrange Limited using the negotiated procedure without prior publication of a contract notice pursuant to Article 28 (1) of Commission Directive 2009/91/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contract Regulations 2011).
The requirement can only be placed with Drumgrange Limited for technical reasons related to the accumulated technical expertise and technical know-how which only Drumgrange has at its disposal having been built up over the lifetime of the contracts referred to above required to support the MTSS. Only Drumgrange has the intimate knowledge and understanding of the existing legacy system to provide the necessary services and create bespoke solutions to address legacy issues.
To procure the support to this equipment from another supplier including any repair and spares provision would also introduces significant risk in relation to the compatibility and interoperability of such spares and the technical and safety certification of such repairs to the Authority's reasonable satisfaction. Whilst it may be possible to create manufacturing data packs sufficient to allow another supplier to provide the services, the Authority believes it would take up to 12 months to do so by which time the proposed contract is expected to have expired.
The Authority is currently looking at a range of procurement options for the provision of a future MTSS system, to replace the current legacy system upon expiry of this proposed contract, which will include open competition where appropriate.
