with the strict conditions stated in the Directive.
g)Service contract awarded to the successful candidate or one of them after a design contest.
h) For supplies quoted and purchased on a commodity market.

j) All tenders submitted in reply to an open procedure, a restricted procedure or competitive dialogue were irregular or
unacceptable. Only those tenderers were included in the negotiations which have satisfied the qualitative selection criteria.
Other justification for the award of the contract without prior publication of a
contract notice in the OJEU:
k) The contract has as its object services listed in Annex B of Directive 2004/18/EC or in Annex XVII B of Directive 2004/17/EC
l) The contract falls outside the scope of application of the relevant directive.
In addition to the box(es) ticked above please explain in a clear and
comprehensive manner why the award of the contract without prior publication of
a contract notice in the OJEU is lawful, stating in any case the relevant facts,
and, as appropriate, the conclusions of law in accordance with the articles in
the relevant Directive (500 words maximum):
—Doctors.net.uk (DNUK) is the largest authenticated network of doctors in the UK with over 53 000 GP members (estimated at 90-95 % of the total UK GP audience)
—The database provides access to over 2 000 000 doctors globally 1 in 4 GPs log in every day (12 000+). Therefore providing the Trust access to a far wider GP audience for our GP Education Days than the Trust could possible reach through their own direct marketing or through the creation of our own GP database.
— Each GP spends on average over 4 hours per month on the site.
— It is the only supplier which currently has access to the largest GP audience, accredited digital education and engagement programmes, display advertising, recruitment and market research.
— Promotion of the Services (GP Education programme) to the Target Audience (GP's) using a variety of promotional methods during a bespoke Campaign Period (usually 8 weeks before each event). This promotion will encourage doctors to view the educational events online, to engage with relevant service information, to download supporting materials and to visit The Royal Marsden website.
—They promote The Royal Marsden as the gold standard in cancer care to all their GP subscribers and build TRM's educational webcasts within the Cancer Insight Centre, to place TRM at the heart of cancer care on M3.
— Facilitate a digital relationship with The Royal Marsden by promoting our Oncology Update newsletter and gathering sign-ups.
— Doctors.net are part of a parent group M3 which means further access to an international audience which will be extremely beneficial to the Trusts private Care marketing strategy.
— In 2015 we moved onto a Cancer Insight Centre sponsored by our education partner CRUK and hosted by M3. We own the education section and have built up a brand equity on this site which is invaluable as is the partnership equity with CRUK.
— Webcast production — production and hosting of The Royal Marsden education day programme webcasts on the Cancer Insight Centre.
— CIC provides oncologists, haematologists, GPs and other medical professionals involved in cancer care professionals key information and a secure online forum where doctors can share information.
