j) All tenders submitted in reply to an open procedure, a restricted procedure or competitive dialogue were irregular or
unacceptable. Only those tenderers were included in the negotiations which have satisfied the qualitative selection criteria.
Other justification for the award of the contract without prior publication of a
contract notice in the OJEU:
k) The contract has as its object services listed in Annex B of Directive 2004/18/EC or in Annex XVII B of Directive 2004/17/EC
l) The contract falls outside the scope of application of the relevant directive.
In addition to the box(es) ticked above please explain in a clear and
comprehensive manner why the award of the contract without prior publication of
a contract notice in the OJEU is lawful, stating in any case the relevant facts,
and, as appropriate, the conclusions of law in accordance with the articles in
the relevant Directive (500 words maximum):
It is considered that this contract must be placed using the negotiated procedure without prior publication pursuant to Regulation 32(2)b) of the Public Contracts Regulations 2015 as to place the contract with another supplier at this juncture would result in disproportionate and significant additional costs to the Forces. It would also lead to unacceptable technical issues and difficulties and could lead to delay and disruption to key areas of public safety, including relating to emergency incidents, potentially endangering the public. The Police Reform and Social Responsibility Act 2011 created a legal duty on chief officers and policing bodies to keep collaboration opportunities under review and to collaborate where it is in the interests of the efficiency or effectiveness of their own and other police force areas. Devon and Cornwall Police (DCP) and Dorset Police (DP) have signed a formal Strategic Alliance Agreement (SAA) under the terms of this Act. The Agreement identifies that the 2 Forces will work together as preferred partners to preserve, safeguard and where possible, transform our service to the public, with the stated aims of: a) acting as a lever for change for both Forces; b) Whenever possible, ‘services should be integrated and delivered through a single team and streamlined management structure, unless proven inefficient or ineffective to do so’; and c) To deliver significant cost reduction. The Command and Public Contact (CPC) function is a business area that fits with these aims. This function is the core unit that receives contact from the public e.g. emergency 999 calls and then despatches appropriate resource to deal with incidents. CPC uses several different software products to deliver its function, 1 of which is the software to electronically assess resource availability and despatch appropriate and available resource. Within DCP it uses the Sopra–Steria STORM product, which was procured via an OJEU tendering exercise and has a further 2 years remaining under its contract. DP currently uses an in-house developed and support solution but this is now at the end of its economic life and requires replacement. Both Forces have accepted a business case to create 1 CPC function operating as a single service model. In order to enable this and maximise efficiencies, the 2 Forces will need to use the same software product for the resource assessment and despatch function. This is required to mitigate against public safety implications which would be caused through delays in operators needing to access different software system, depending on the geographic area a call came from. In order to facilitate this single system approach DCP will be procuring an expansion of its existing licenses for the STORM product to cover its use by both DCP and DP.
