II.2.4) Description of the procurement
The Chemical biological radiological and nuclear delivery team, part of the UK Ministry of Defence (“MOD”), intends to award Crew systems corporation (the “Contractor”) a contract for the manufacture, supply and in-service support, including post design service enhancements of 524 Aircrew Helmet and Respirator systems. The requirement is seeking a fully mature Technology readiness Level 8 system completed and qualified through test and demonstration including platform integration and flight trials. This shall include technical input for development of the System safety case and the evidence required to achieve Release to service on specified aircraft types. The contract duration will be for a maximum duration of seven years (inclusive of option periods).

Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation:
The Chemical biological radiological and nuclear delivery team, part of the UK Ministry of defence (“MOD”), intends to award Crew systems corporation (the “Contractor”) a contract for the manufacture, supply and in-service support, including post design service enhancements of 524 Aircrew Helmet and Respirator systems. The requirement is seeking a fully mature Technology readiness Level 8 system completed and qualified through test and demonstration including platform integration and flight trials. This shall include technical input for development of the System safety case and the evidence required to achieve Release to service on specified aircraft types. The contract duration will be for a maximum duration of seven years (inclusive of option periods). The value of the contract is estimated to be 29 000 000 GBP.
It is considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice as permitted by Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011) for technical reasons.
Crew systems are the only supplier who have the technical capability to fulfil the Authority’s requirement to supply the Aircrew protection equipment detection (APED) systems. Crew systems are the Original equipment manufacturer (“OEM”) and the Design Authority (“DA”) for the APED system. Crew Systems hold the background technical data required to manufacture an APED system.
The APED system is currently the only integrated helmet and respirator solution with a don-in-flight capability on the market and therefore is the only system capable of meeting the Authority’s requirement.
The APED system is the only solution currently on the market that has a helmet fully compliant with the Military aircrew helmet impact standard (Defstan 05-102 (2)). Therefore the APED system is the only solution capable of meeting the Authority’s impact protection requirements and ensuring safety for the user.
Crew systems are the only supplier with the technical capability to provide in-service support to the APED system. Crew systems are the OEM for various spares and they are the DA and hold the background technical data required to service the systems. As OEM and DA Crew systems have also built up the necessary technical knowledge and experience to provide this support.
In addition, Crew systems hold extant patents (GB2413754, US7234812) covering the method and apparatus for manufacturing a custom fit optical display helmet meaning only Crew systems can carry out the custom fitting of the helmet liners which is a key element of the support services required under the proposed contract.
