YPO were looking for providers to be appointed onto a Dynamic Purchasing System (DPS) for the provision of Enforcement Agency Services including High Court Enforcement. This includes the collection of all debt types which a Contracting Authority may have a requirement to collect and other services an enforcement agent can typically provide.
All providers had to be registered enforcement officers and/or High Court Enforcement Officers and comply with The Taking Control of Goods Regulations 2013, The Taking Control of Goods (Fees) Regulations 2014 and The Certification of Enforcement Agents Regulations 2014 (including any amendments).

There were no guarantees as to any minimum or maximum amount of services to be provided during the term of the DPS. Service providers noted that the model call off terms and conditions attached to the DPS contract could be changed in whole or in part by the customer. The customer could choose to use their own terms and conditions and will supply these when a call for further competition was made or elect to accept a service providers terms and conditions. The customer may choose to award the call for further competition to one or more service providers following evaluation. Any Contracting Authority who entered into a call off contract under this DPS reserved the right to include ancillary services as part of their invitation to tender which fell outside of the above regulations.

In accordance with Regulation 34(28)(b) of the Procurement Contract Regulations 2015, this notice is intended to confirm the expiry of the 000774 Enforcement Agency DPS. Individual award notices were issued for each further competition completed under the DPS during its period of validity.

YPO incorporated a standstill period at the point of notification of the award of Round 1. The standstill period was for a minimum of 10 calendar days, and provided time for unsuccessful tenderers to challenge the award decision before the DPS commenced. The Public Contracts Regulations 2015 provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England,Wales and Northern Ireland).
