Abstract

Newry, Mourne and Down District Council wish to procure construction services of a suitably qualified and experienced contractor as a single-supplier under a framework arrangement to deliver a wide range of infrastructure and engineering works. The framework will be used by council as a comprehensive contractual solution to deliver a broad range of infrastructure works on or relating to Council lands and property.

The single contractor will be appointed onto an NEC4 framework contract and will be required to engage, employ and manage supply chains as required by each work package placed. Work to be carried out under the framework will be wide ranging and include but not be limited to; environmental improvement schemes, site investigations, drainage installations, roadway and footway resurfacing works, play parks, structural bases, earthworks, tree and street furniture installations, etc. The NEC4 engineering and construction short contract will be used for works packages under the framework.

The economic operators’ performance on this contract will be regularly monitored.

If an economic operator fails to reach satisfactory levels of performance the economic operator may be issued with a certificate of unsatisfactory performance.

The issue of a certificate of unsatisfactory performance will result in the economic operator being excluded from all procurement competitions being undertaken by Contracting Authorities on behalf of bodies covered by the Northern Ireland Procurement Policy for a period of 12 months from the date of issue of the certificate. The Authority expressly reserves the rights:

(i) not to award any contract as a result of the procurement process commenced by publication of this notice or to cancel the procurement at any stage;

(ii) to make whatever changes it may see fit to the content and structure of the tendering competition;

and in no circumstances will the Authority be liable for any costs, charges or expenses incurred by candidates irrespective of the outcome of the procurement process or if the procurement process is cancelled or postponed. Any expenditure, work or effort undertaken prior to contract award is accordingly at risk of the company participating in this procurement process. Economic operators should be aware that up to the point the contract becomes unconditional, all costs, charges and expenses are the economic operator’s and the Contracting Authority will not reimburse any costs incurred prior to this stage. All discussions and correspondence shall be deemed strictly subject to contract until the contract is entered into. The contract shall not be binding until it has been signed and dated by duly authorised representatives of both the Newry, Mourne and down District Council and the economic operator. All dates and time periods specified in the procurement documents are provisional only and the Contracting Authority reserves the right to change these. This project will be used to progress the Government’s wider social, economic and environmental objectives.

Precise information on deadline(s) for review procedures:

This procurement is governed by the Public Contracts Regulations 2015 which provides for economic operators who have suffered, or who risk suffering, loss, or damage, as a consequence of an alleged breach of the duty owed in accordance with Regulation 91 to start proceedings in the High Court.

A standstill period will commence at the point information on the award of the contract is communicated to tenderers. That notification will provide information on the award decision. The standstill period, which will be for a minimum of 10 calendar days, provides time for unsuccessful tenderers to challenge the award decision before the contract is entered into.

Any proceedings relating to any perceived non-compliance with the relevant law must be started within 30 days, beginning with the date when the economic operator first knew, or ought to have known that grounds for starting the proceedings had arisen.
