Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation
The services can be provided only by a particular economic operator for the following reason:
Absence of competition for technical reasons.
Explanation: Use of a PIN as a call for competition.
The PCR 2015 permits sub-central authorities to advertise contracts by issuing a PIN as a call for competition instead of an OJEU notice if they are using the restricted procedure, or competitive procedure with negotiation (regulation 26(9), PCR 2015). Broadly, sub-central authorities are Contracting Authorities that are not central government departments or otherwise listed in Schedule 1 to the PCR 2015.
Darlington Borough Council has published a PIN as a call for competition for contracts for Schedule 3 services (Regulation 75, PCR 2015). The PIN must:
— be published continuously,
— contain the information set out in part I of Annex V to the Public Contracts Directive 2014,
— refer specifically to the types of services that will be the subject-matter of the contracts to be awarded,
— indicate that the contracts will be awarded without further publication and invite interested suppliers to express their interest in writing.
Note that, where used for a Schedule 3 contract, the PIN may cover a period which is longer that 12 months. This opportunity is made available in accordance with the above provisions.
