This is a voluntary ex ante transparency (VEAT) notice. This notice is to indicate that Network Rail intends to contract with Elektrotechnische werke fritz Driescher and söhne gmbh, Morris Line Engineering and SDCEM, for the purchase of 25 kV AC disconnector motor mechanisms and remote securing modules to be retrofitted onto existing devices on the UK railway network.

II.2.4) Description of the procurement
Network Rail seeks to retrofit remote securing capability onto existing 25 kV AC disconnector systems already fitted across the network. This activity is essential to protect safety of trackside workers. These items must be sourced from OEM to ensure compatibility and to protect existing warranty for the disconnectors.
It is Network Rail's intention to operate a full tender for disconnectors with remote securing technology after this STA as an open competition, contracts will be awarded subject to suppliers receiving product approval.

Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation:
Network Rail Infrastructure Ltd (‘NR’) intends to place a contract with the Dreicher and Sohne, Morris Line Engineering and SDCEM Ltd to source remote securing capability to disconnectors fitted across the railway. Competition is absent due to intellectual property rights, compatibility and warranty considerations for the disconnectors already fitted across the network. It is considered that this contract can be placed using the Negotiated Procurement Without Prior Publication pursuant to Article 50 (c) (iii) of Directive 2014/25/EU of the European Parliament and of the Council
(Regulation 50 (1) (c) (iii) of the UK Utilities Contracts Regulations 2016) on the basis that the contract may be awarded only to these aforementioned suppliers. The value of the contract is GBP 5 640 000.
