Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation:
The Secretary of State for Defence (The Authority) intends to enter into a contract with Aviation and Defence Spares Ltd (ADS) for the spares inclusive repair, procurement of spares and post design services for aircraft oxygen, environmental control and hydraulic equipment. The contract has an estimated cost of GBP 4 855m (inc. vat) for a five year contract.
It is considered that this contract can be placed without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011) for technical and exclusivity reasons. These include that Honeywell Aerospace UK are the design authority for the repair, spares and PDS services and is the only economic operator with the necessary technical data, proprietary information, test equipment, knowledge and experience critical to provide the contracted services to maintain operational capability and ensure the safe functioning of the associated aircraft. Aviation and Defence Spares Ltd (ADS) are Honeywell’s licenced representatives in the UK. Other manufacturing bodies would have to develop an in-house design, manufacture, repair, test, qualification, certification and flight clearance capacity to assure a properly engineered and fully documented solution. This option would not deliver the critical spares in a timely manner to assure flight safety.
