The procurement falls outside the scope of application of the Directive
Explanation
Great Western Hospitals NHS Foundation Trust (the Contracting Authority) intend to award a contract to Quidel for the provision of its Triage BNP Access, control and calibrators at the Great Western Hospital, Swindon.
At present, the Trust holds an equipment contract with the manufacturer, Beckman, for the provision of testing on the contract provided main analyser. For compatibility, the Trust must procure its Triage BNP access, controls and calibrators from the intended provider, who owns the intellectual property (thus patented consumables) for running the tests against the Trust's existing analyser.
To procure alternative products, the Trust would be expected to source alternative equipment, which would not be commercially or operationally viable for the Trust.
Therefore, the interdependency and reliance of shared services from both the intended provider and the existing equipment manufacturer contract means that an alternative economic operator would not find it financially viable to replicate the infrastructure that would be economically or operationally manageable for the contracting authority.
