capacity as Design Authority, are the sole manufacturer of spares, components and associated items for the Yamaha Quadbike and will only supply direct to the UK Ministry of Defence.

The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation
Babcock Land Defence Ltd, acting as agent for the UK Ministry of Defence has awarded has awarded a 4 year Framework Agreement, using the Negotiated Procedure Without Prior Publication pursuant to Regulation 32(2)(b)(ii) of the PCR Contracts Regulations 2015 to Yamaha Motor Europe Ltd, on the basis that, Yamaha Motor Europe Ltd, in its capacity as Design Authority, are the sole manufacturer of spares, components and associated items for the Yamaha Quadbike and will only supply direct to the UK Ministry of Defence. They own the rights to the
technical specifications required to undertake the manufacture, testing and supply. Yamaha have stated that
they are not willing to share this knowledge/expertise with any third party, including the UK Ministry of
Defence. Without access to this, the UK Ministry of Defence is not in a position to be able to identify the
exact technical requirements for the material or manufacture and as a result, Yamaha Motor Europe are the
only supplier able to fulfil this Contract.
