This Lot sought suppliers who can provide good quality accommodation and manage the specific needs of our service users - this accommodation must be within Kirklees Local Authority boundary.

Provision of short term nightly paid accommodation, predominantly for homeless service users in hotel and guest house accommodation. Accommodation will be provided until alternative temporary accommodation within the Council's dispersed temporary accommodation stock can be found, or until the service user is found suitable accommodation.

The accommodation will be provided under a license under s188 of the Housing Act 1996 which will be between the Council and the resident

We are seeking suppliers who can provide good quality short term nightly paid accommodation, predominantly for homeless service users in self-contained and self-catering accommodation - this accommodation will be outside of Kirklees Local Authority boundaries but must be within a 30-mile radius of Huddersfield Town Centre.

This accommodation will be provided until alternative temporary accommodation within the Council's dispersed temporary accommodation stock can be found, or until the service user is found suitable accommodation.

The accommodation will be provided under a license under s188 of the Housing Act 1996 which will be between the Council and the resident.

This type of accommodation will primarily be used for families with dependent children so they do not have to be placed into hotel type accommodation but may also be used for single service users where it is not appropriate for them to stay in hotel type accommodation.

Further to PCR 50(6) it has been determined that the details of the successful tenderers on this Framework may be contrary to the public interest and publishing this information may put vulnerable service users at risk of harm, therefore the names of the suppliers awarded a position on this Framework have been redacted from this notice.

There is provision to extend this Framework for up to two (2) further twelve (12) month periods until 2nd April 2028.

Precise information on deadline(s) for review procedures:

In accordance with Regulation 86 (Notices of decisions to award a contract or conclude a framework), Regulation 87 (Standstill periods) and Chapter 6 (Applications to Court) of the Public Contracts Regulations 2015 (SI2015/102), the contracting authority incorporated a minimum ten (10) calendar day standstill period at the point that information on the award of the Framework was communicated to economic operators.

This period allowed any unsuccessful economic operator(s) to seek further debriefing from the contracting authority before the award of the Framework to the successful economic operators.

Such additional information was available on request from the address at Sections I.1 and I.3 of this Notice above.

If an appeal regarding the award of the Framework has not been successfully resolved, then the Public Contracts Regulations 2015 (SI 2015/102) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland).

Any such action must be started within thirty (30) days beginning with the date when the aggrieved party first knew or sought to have grounds for starting the proceedings had arisen. The Court may extend the time limited for starting proceedings where the Court considers that there is a good reason for doing so, but not so as to permit proceedings to be started more than three (3) months after that date.

Where the Framework has not been awarded, the Court may order the setting aside of the award decision or order the contracting authority to amend any document and may award damages.

If however the Framework has been awarded, the Court may only award damages or, where the contract award procedures have not been followed correctly, declare the Framework to be ineffective.
