Abstract

Craven District Council has identified an opportunity to establish a strategic developer partnership arrangement to lead, guide, influence and develop opportunities to secure long lasting and sustainable regeneration in the District. The Council has ambitious plans to regenerate areas of Craven. It is proposed that a Special Purpose Vehicle will be established between the Council and a Private Sector Partner to which the Council will initially commit a site which will be the focus of the initial development. Thereafter, the Council will work in partnership with the preferred Developer to identify development opportunities within Craven. The successful tenderer is expected to enter into a long-term arrangement with the Council and provide funding, wider development management experience and related services as relevant. The partner(s) will be expected to utilise their expertise, funding and resources to take forward, develop and potentially manage any opportunities committed to the SPV by the Council.

III.1)

Conditions Relating to the Contract

III.1.1)

Deposits and guarantees required

Performance and/or parent company guarantee and/or a performance bond may be required. Further information will be provided to those invited to tender.

III.1.2)

Main Terms of financing and payment and/or reference to the relevant provisions

The successful tenderer will be required to secure or provide financing for an interest in the proposed Special Purpose Vehicle and must demonstrate the ability and covenant strength to raise and/or provide finance as part of the contract award process. The Authority will enter into discussions on the form of financing and payment to meet the needs of developments as they arise.

Legal form to be taken by the grouping of suppliers, contractors or service providers to whom the contract is to be awarded

The Authority will consider proposals for a Special Purpose Vehicle including creating a Joint Venture to deliver the development. The Authority reserves the right to require a lead developer further to undertake the primary contracting responsibility for the contract or to require that one or more parties are jointly and severally liable.

Yes. Under the project(s) the developer partner will be required to actively participate in the economic and social regeneration of the area. Accordingly, the award criteria and contract performance conditions may relate to social and environmental conditions.
