IV.1.1) Type of procedure
Negotiated procedure without publication of a contract notice
Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation:
Ship Acquisition, which is part of the UK Ministry of Defence (MOD), proposes to place a contract with GE Energy Power Conversion Limited (Company Registration Number 5571739) (‘the Company’) for the provision of spare components for the Gas Turbine Alternator and HV Propulsion System, which have been manufactured and installed by the Company on the Queen Elizabeth Class (QEC) Aircraft Carriers (the ‘Contract’).
The Contract covers the supply of components for the Gas Turbine Alternator and High Voltage (HV) Distribution System (‘the Systems’) comprising the following: gas turbine alternator rotor, stator and exciter, propulsion motor stator, and harmonic filter reactors and resistors (‘the Goods’). The contract has an estimated value of 4 900 000 GBP (four million and nine hundred thousand pounds) and a duration of 18 months.
It is considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(3)(a) of Directive 2009/81/EC of the European Parliament and of the Council (Regulation 16(1)(b)(i) of the Defence and Security Public Contracts Regulations 2011). This is because to procure the Goods from a manufacturer other than the Company would oblige the MOD to acquire goods having different technical characteristics, which would result in incompatibility between the System and the Goods so acquired and disproportionate technical difficulties in operating and maintaining the System.
It is also considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC of the European Parliament and of the Council (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011) for technical reasons. This is because the Company is the only economic operator with the necessary technical know-how, proprietary processes, and equipment-specific tooling and test equipment to supply the Goods to ensure the functionality of the System.
