Gateway Housing Association have undertaken a competition under Category 10 — asbestos – removal of procurement for housing's compliance services and associated works dynamic purchasing system, OJEU Contract Notice — 2018/S 171-388633, in order to appoint an experienced service provider to undertake asbestos removal at properties owned/managed by Gateway Housing Association. It is intended that the contract established will run for an initial term of 3 years, extendable for a further term of 2 years via annual extensions. Any extension will be at the discretion of Gateway Housing Association. The estimated contract value for asbestos removal is 40 000 GBP (exc VAT) per annum. Gateway Housing Association will utilise JCT Measured Term Contract 2016 with amendments.

Gateway Housing Association incorporated a discretionary standstill period at the point information on the award of the contract was communicated to tenderers. That notification provided full information on the award decision. The standstill period, which was for a minimum of 10 calendar days, provided time for unsuccessful tenderers to challenge the award decision before the contract is entered into. The Public Contracts Regulations 2015 (SI 2015 No 102) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales, and Northern Ireland).
