IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation
This procurement is for the purchase of Quantiferon Plus (IGRA) test kits from Public Health England (PHE) under Regulation 12 (7) (a) (b) and (c) of the PCR 2105, contracts which establish or implement cooperation between contracting authorities where:
(a) the contract establishes or implements a cooperation between the participating contracting authorities with the aim of ensuring that public services they have to perform are provided with a view to achieving objectives they have in common;
(b) the implementation of that co-operation is governed solely by considerations relating to the public interest; and
(c) the participating contracting authorities perform on the open market less than 20 % of the activities concerned by the cooperation.
The service PHE provides in cooperation with Belfast Health and Social Care Trust (BHSCT) is to provide lab test results from patient testing to health professionals caring for those patients. In this way the public services that both parties have to perform are provided with a view to achieving the objectives both PHE and BHSCT have in common. These objectives are started below.
1) PHE exists to protect and improve the nation’s health and well-being, and reduce health inequalities. BHSCT exists to improve health and well-being and reduce health and social inequalitie;
2) Both PHE and BHSCT work together in this way with the sole aim of providing a service to patients and healthcare professionals engaged in their care. Thus this cooperation is governed solely by considerations relating to the public interest;
3. Quantiferon (IGRA) tests are performed for patients throughout the NHS. The National Institute for Health and Care Excellence (NICE) guidelines for Tuberculosis, guideline [NG23] 2016, recommends this test for a number of patient groups. The BHSCT/PHE IGRA testing constitutes less than 20 % of those tests performed nationally throughout the NHS.
