Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation:
The land equipment vehicle support team, part of the UK Ministry of Defence intends to place a contract with Hydac Technology Ltd (‘the Contractor’) for the purchase of 180 hydraulic track tensioning control accumulator kits, used in connection with the challenger II platform, to the latest acceptable challenger II build standard. It is considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011) for technical reasons. This is because only the contractor as the design authority for the control accumulator have access to the complete set of technical specifications, design, and technical information, expertise, knowledge and know-how necessary to manufacture the articles to the latest acceptable build standard and, as the articles form part of a safety critical system to the operation of the platform, the articles must be manufactured in accordance with the relevant technical specifications in order to meet operational safety requirements.
