Abstract

Portsmouth City Council — the ‘Council’ — intends to appoint Alun Griffiths (Contractors) Ltd — the ‘Contractor’ — to deliver road, highways and associated redevelopment works within Portsmouth city centre and the surrounding environs including for infrastructure which serves/adjoins the city centre on a design and build partner contracting basis.

The scope of works and services that may be contracted via the framework agreement include for but are not limited to ECI activities, modelling, design, planning, financing strategy, securing grant funding, project management, surveys, enabling works, road and highways construction works, public realm improvement works, street furniture installation, street lighting installation, traffic signals and signage installation, traffic calming works, installation of road safety measures, cycle lane construction, hard and soft landscaping, public transport infrastructure, surfacing works, utility diversions, traffic management, drainage works, wall construction, maintenance activities.

The contractor will be appointed on the basis of a framework agreement which will allow for incremental call-off of design and construction works on a draw down basis. The framework agreement will commence on 14 September 2020 and will run for an initial term of 4 years extendable in increments to be agreed up to a maximum total term of 8 years.

The total value of work — inclusive of ECI, modelling, design, surveys, works, etc. — that may be let via the framework agreement could be in the region of GBP 70 million over the total allowable term, however actual values could be significantly lesser or greater dependent upon how plans for the regeneration of the city centre and surrounding environs develop in the future. The value and volume of work let will also be impacted upon by the success of the Council in raising finance via securing of grant funding and other means.

VI.3) Additional information

The contractor will be awarded the framework agreement following completion of an OJEU advertised competitive procedure (2018/S 088-196692) concerned with securing a partner design and build contractor to deliver new road, highways and associated infrastructure within Portsmouth city centre.

During the procurement process the Council took the decision to formally move from a flexible draw down contract to a true framework arrangement following consultation with the contractors who were shortlisted to tender. Whist the contracting form has altered the scope and phased open book partner contracting model is materially consistent with the approach set out within the original OJEU contract notice.

Whilst the OJEU contract notice envisaged an open ended contract duration linked to overall delivery of the scheme the formal move to a true framework agreement has led the Council to define a set term of 4 years extendable in increments to be agreed to a maximum total term of 8 years.

Due to the issue of an enforcement notice on the Council by DEFRA in relation to air quality the redevelopment of the city centre and surrounding environs road, highways and associated infrastructure will not be delivered in accordance with the scheme envisaged when the original OJEU contract notice was issued.

The Council is still committed to making significant improvements to the city centre and surrounding environs road, highways and associated infrastructure including for infrastructure which serves/adjoins the city centre and is actively developing new plans for this. Whilst the envisaged infrastructure improvements are different to the original scheme envisaged the scope of works and services as listed within sections II.2.2) and II.2.4) of this award notice together with scale, value and flexible phasing approach set out within the award notice are materially consistent with what was stated within the OJEU contract notice.

As per the OJEU contract notice the exact timescales for when work packages will be drawn down cannot be accurately forecasted as delivery will be dependent upon a number of variables outside of the Council's direct control such as developer behaviour, economic conditions, new grant funding opportunities, developing transport strategies, central government policy changes, etc. It should be noted that the Council is actively pursuing funding from a range of sources which if successfully obtained may allow for commencement of significant works in 2020-2021.

As per the original scheme it is vital that a holistic approach to improvement of city centre infrastructure is adopted which will require working with a single consistent design and build partner contractor to ensure effective modelling, design and phasing of works.
