The works, supplies or services can be provided only by a particular economic operator for the following reason: protection of exclusive rights, including intellectual property rights
Explanation
As per Reg 32.2(b)(iii) Emergency One has exclusive rights to support and maintain the Magirus Ladders currently in use by NIFRS, as this supplier holds the intellectual property rights and source code and therefore is the only supplier that can provide this service.
