IV.1) Description

IV.1.1) Type of procedure

Award of a contract without prior publication of a call for competition

Justification for selected award procedure:

Extreme urgency brought about by events unforeseeable for the contracting authority and in accordance with the strict conditions stated in the Directive

Explanation

As the UK now finds itself responding to Covid-19, it was be prudent award the Type IIR Face Masks purchases without a call for competition to allow the Council to provide a sustained response for the duration of the Covid-19 pandemic immediately and in the recovery phase activities. This could not have been anticipated by the Council and an urgent response was required to protect the people of Doncaster especially those working in the Care Sector.

The outbreak of Covid-19 is unprecedented and will have a significant impact on businesses of all sizes. Many suppliers to public bodies will struggle to meet their contractual obligations and this will put their financial viability, ability to retain staff and their supply chains at risk.

This award satisfies all the grounds in Regulation 32, as shown below.

32(2)(C) – urgency ground

1) there are genuine reasons for extreme urgency;

2) the events that have led to the need for extreme urgency were unforeseeable;

3) it is impossible to comply with the usual timescales in the PCRs;

4) there is no time to place a call off contract under an existing commercial agreement such as a framework or dynamic purchasing system;

5) the situation is not attributable to the contracting authority.
